Cancellations, Refunds and Chargebacks Policy

Donation Refunds

On behalf of Scoreboard, LLC (d/b/a Scoreboard Fundraising) and our charitable affiliates, we are grateful for your donation and support. Refunds are only granted in exceptional circumstances, within 10 (10) days of the donation date, and are returned using the original method of payment. A request for refund must be submitted in writing, with sufficient supporting documentation, where applicable. Refunds will be executed within 10 days from the receipt of receipt of a written request, subject to our review and discretion, and based on consideration of the following exceptional circumstances. If the fundraiser has been closed and the funds transferred to the school or organization, you will need to request a refund from the appropriate school or organization.

Some exceptional circumstances in which refunds might be granted include:

  • The donation was made in error, had an incorrect amount, or the selected charity or recipient was not that intended by the donor
  • The donation was not authorized by the donor
  • The donor’s circumstances have changed materially, for instance if the donation was made from the proceeds of a sale that was later canceled or refunded, or, the donor has become bankrupt or insolvent

Recurring Donation Refunds

Donors have the option to give recurring or one-time donations. We are only able to refund donations from the thirty (30) days before the date of the refund request. See Donation Refund Policy above.

Charitable Tax Status

If the donor has filed a tax return claiming a charitable deduction for the refunded gift, the donor is responsible for contacting their tax advisor to determine if their tax return needs to be amended.

Chargeback Policy to Prevent Fraud

Scoreboard Fundraising maintains a “zero tolerance” policy concerning chargebacks, in light of recent issues related to fraudulent requests for chargebacks.

As a condition of making a donation through Scoreboard Fundraising, you agree not to file a chargeback with your electronic payment issuer/card issuer, which means you cannot file a dispute with these entities in an attempt to have them cancel or refund your donation. Rather, should you be seeking a refund, you agree to communicate the exceptional circumstances which require such refund in writing to Scoreboard Fundraising, in accordance with our Donation Refund Policy.

Because you agree not to file a chargeback/dispute with your electronic payment issuer/card issuer, any chargeback/dispute which is filed is necessarily a breach of your agreement with Scoreboard Fundraising, and further, a willful breach which rises to the level of fraud.  Such fraud may be prosecuted against you individually or, against the business you represent, to the fullest extent of the law.

If necessary, Scoreboard Fundraising will take immediate action against any individual or business that files a chargeback, including legal action, including but not limited to the following:

  • Denying the ability to make a donation or otherwise use our services to you or your affiliates in the future;
  • Blocking you from access to our services in the future;
  • Reporting you to appropriate law enforcement agencies, regulatory authorities, better business bureaus, the Federal Trade Commission (FTC), the Internet Crime Complaint Center (IC3), and any other entities with authority to assist with claims of fraudulent practices;
  • Issuing a press release or other truthful warnings to customers/vendors;
  • Sending the matter to third-party collections agencies or law firms;
  • Disclosing to third-parties any information needed to prosecute fraudulent activities, including but not limited to your contact information, phone or e-mail communications with us, contracts, payment history, and proof of authorization of payment.

In addition to the above actions, Scoreboard Fundraising reserves all rights and remedies at law and in equity, including under theories of breach of contract, breach of the covenant of good faith and fair dealing, material misrepresentation, negligent misrepresentation, fraud in the inducement, and statutory fraud in the jurisdiction where you, or we, or both of us are located.

NOTE THAT OUR CHARGEBACK POLICY ONLY GOES INTO EFFECT IN THE EVENT THE CHARGEBACK IS SUCCESSFUL, IF THE CHARGEBACK WAS INITIATED BY MISTAKE AND THE CHARGEBACK IS PROMPTLY CANCELED, THE ABOVE ACTIONS WILL NOT BE TAKEN.
